1. Scope of application

The business relationship between ETRE GmbH, Fochstrasse 55, CH 8032 Zurich, Switzerland (herein- after „Seller“) and the customer (hereinafter „Customer“) for transactions in the Online Store (www. etre. space) shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the respective order.

Any conflicting or other general terms and conditions and/or other conditions of the customer are ex- pressly rejected, irrespective of their designation, unless the seller expressly agrees to their validity in writing.

We are entitled to supplement, amend or delete the General Terms and Conditions at any time.

2. Important notes

a) The Internet pages of the seller merely represent an invitation to the customer to submit offers for the conclusion of a sales contract for the presented goods.

b) We endeavour to reproduce the colours of the products truthfully. We would like to point out that there may be slight deviations, which are mostly due to the colour settings of the smartphones or monitors and do not constitute a defect. Should you have any additional questions about our products, we look forward to hearing from you (contact@etre.space). The sizes of the bags are indicated in the respective descriptions, we kindly ask you to consider this before ordering.

3. Conclusion of contract

(1) By ordering the desired goods and pressing the „order now for a fee“ button, you make a binding offer to conclude a contract, which is accepted by us without further confirmation by sending the goods.

b) The Seller will only accept the Customer‘s online offer. Orders sent by other means of transmission, in particular by e-mail or letter, shall not be accepted and processed by the Seller.

c) Before sending the order, the customer can view and change the order data at any time via the „Shop- ping Cart & Checkout“ button.

d) The customer then receives an automatic confirmation of receipt by e-mail, which reproduces the con- tent of the customer‘s order once again and which the customer can print out. This automatic confirmation of receipt does not represent an acceptance of the offer, but merely documents that the order has been received by the seller.

e) The contract is only concluded when the seller submits the declaration of acceptance. The seller is entit- led, but not obliged, to accept the customer‘s contractual offer within 10 days of receipt by the seller. The seller declares acceptance by means of a dispatch confirmation sent by e-mail.

4. Registration to facilitate the use

To facilitate the use of the online store, the seller offers the customer the opportunity to register for a cus- tomer account. In this case, the customer does not need to enter his data again for each order, they are rather stored in the customer database of the seller and automatically inserted into a new order.

b) In order to register as a customer, the Seller requires the following information:
Surname, first name, address, date of birth. a possibly different delivery address, as well as an e-mail address. The customer enters these data into an input mask. They are stored in the customer database of the. The data is stored in the seller‘s database when the customer clicks on the „Register now“ button. The seller will only use the stored data in compliance with the applicable data protection regulations.

c) Following registration, the customer automatically receives an e-mail informing him that his customer account has been set up. The customer‘s e-mail address also serves as the user name for the customer account. During the registration process, the Customer is asked to enter a password of his choice. The customer has the possibility to change this password after logging into his customer account. The custo- mer must keep the access code and password secret at all times, may not disclose them to third parties and is obliged to protect his access code and password against unauthorised access by third parties. The customer is responsible for any misuse of the access code and password.


5. Delivery and shipping costs

5.1 Delivery

Unless otherwise agreed, the goods shall be delivered ex warehouse to the delivery address specified by the customer. The goods shall be shipped via a logistics service provider. The relevant prices are those quoted at the time the order is placed; these are gross prices, i.e. including the respective statutory value-added tax and excluding the shipping costs incurred pursuant to paras. 5.3 and 5.4.

5.2 International delivery

We deliver to all countries listed under menu item 5.3. In general, we cannot deliver to P.O. box addres- ses or packing stations.

5.3 EU, EFTA, USA, Japan, Singapore. There are no further costs. All import taxes and customs duties are already included in the purchase price. For delivery to a country which is not mentioned above, customs, VAT and import taxes are payable. These are to be paid by the receiver with the acceptance of the supply.

5.4 Shipping costs

The shipping price depends on the country of delivery as well as the contents of the shopping basket and is displayed in the checkout at step „Delivery“. The seller informs the customer of the respective shipping costs as well as any additional costs in the order form. The customer has to pay the shipping costs and any additional costs.

5.5 Delivery time

For the regions listed below, the following delivery times apply without obligation (working days Mon- day-Friday):

Switzerland: 2 - 4 days

Europe: 5 - 8 days

Japan, Singapore, South Korea & USA: 4-6 days

All other countries: 12-17 days

6. Payment The payment can take place by PayPal PLUS or prepayment.

Payment can be made by PayPal PLUS or prepayment. Payment must be made within 5 working days after placing the order.

7. Retention of title

The goods remain our property until the purchase price has been paid in full.

8. Warranty for defects

In the case of defects in goods, the statutory warranty regulations shall apply. On delivery recognizable obvious material or manufacturing defects in our articles, including transport damage, we formed im- mediately by notification to us to complain. We will replace the defective goods free of charge for you against return.

9. Copyright and trademarks

The entire content of the Website, including text, graphics, photographs, images, moving images, sounds, illustrations and software, is owned by us or our related companies, licensees or content provi- ders. This content is protected by copyright and other rights. Their use is permitted only with our express permission. All trademarks used on the Site are our trademarks unless otherwise noted. These may not be used without our prior written permission.

10. Return of the goods

10.1 Return of goods

You can return the received goods within 10 calendar days without giving reasons by returning the goods. The period begins at the earliest with receipt of the goods and this instruction. The punctual di- spatch of the goods is sufficient to meet the deadline. The return takes place at your expense and risk.

The return has to take place to: ETRE GmbH, Forchstrasse 55, CH 8032 Zurich, Switzerland.

10.2 All items returned in this way will be checked by us. Purchased products must not show any traces of use. You bear the costs for the return transport. A return will be refused if:

- traces of use are visible.

- the product is damaged due to transport.

Only the sales price will be refunded; any customs duties, taxes and the original shipping costs will not be refunded. Customers from Germany will be given a return address in Germany.

The refund of the sales price will be made in the same way as the original payment reached us. If you have ordered in advance, we ask you to inform us of your bank details.

10.3 If the product has quality defects or was not ordered by you, ETRE will gladly refund the purchase price, the transport costs for the return, the customs duties and taxes incurred (to be proven by receipts) as well as the original shipping costs. The products will not be taken back if the products show signs of use, such as:

- Traces based on normal wear use

- Higher circumstances, such as natural disasters

- Traces of improper use

- Interventions by the buyer or third parties

- Extreme use or extreme influence by the customer

10.4 If the product is lost during the return transport, no costs will be refunded. We recommend to send the product with a supplier who offers Track & Trace.

11. Final provisions

These general terms and conditions and the use of the online shop are subject to Swiss law.

Place of jurisdiction is Zurich

11.1 For customers in Switzerland: The present General Terms and Conditions and contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Zurich.

11.2 For all other customers: Swiss law shall apply to all transactions. Place of jurisdiction is Zurich. However, this shall only apply to you as a consumer to the extent that the protection granted by manda- tory provisions of the law of the country in which you have your habitual residence is not withdrawn. The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

11.3 In the event that individual provisions of these General Terms and Conditions should be invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially in- valid provisions shall be replaced by provisions whose content comes as close as possible to that of the invalid provision.

All content that appears or is displayed on the Website, including but not limited to text, graphics, photographs, images, moving images, sounds, illustrations and software („the Content“), is the property of ETRE GmbH. All elements of the website, including but not limited to the general design and content, are protected by trade dress, copyright, moral rights, trademarks and other intellectual property rights. Except as expressly permitted under these terms and conditions or other agreements with ETRE GmbH, copying or retransmission by any means of any portion or element of the Website or its contents is prohibited, and the Website, its contents and all related rights shall remain the sole property of ETRE GmbH.
